Rechazan varias demandas por daños contra YouTube
Un juez estadounidense rechazó varias demandas por daños y perjuicios en una causa por violación de derechos de autor contra Google y su web de vÃdeos YouTube.com, pero dejó abierta la posibilidad de que propietarios de copyright de fuera de Estados Unidos pudieran pedir indemnizaciones por emisiones en directo, si ganan ante los tribunales.
Un grupo de titulares de derechos de autor de los sectores de la música y el deporte, liderado por la Asociación de Fútbol de la Premier League británica, habÃa alegado que las obras extranjeras estaban exentas de cualquier exigencia de registro incluida en la Ley de Derechos de Autor de Estados Unidos.
Sin embargo, el juez falló que no se pueden exigir daños y perjuicios por obras extranjeras que no estén registradas en Estados Unidos, excepto las que puedan incluirse en la “exención de emisión en directo” de la Ley.
Las compensaciones punitivas están excluidas para todas las demandas, dijo el juez de distrito estadounidense Louis Stanton en un fallo del 3 de julio, reiterando una sentencia anterior que realizó en un caso parecido presentado por Viacom.
Sin embargo, el juez estuvo de acuerdo en que los demandantes podrÃan, si ganaban en un juicio, pedir cierto tipo de compensaciones por vulneración de derechos de autor de eventos en directo.
También podrÃan resarcirse de beneficios perdidos y beneficios ilÃcitos logrados por YouTube y Google en cualquier demanda que ganen en un juicio, dijo el abogado de los querellantes, Louis Solomon.
“Es más importante que cubra la emisión en directo porque para nuestro principal demandante, ese es todo su negocio”, dijo Solomon, de Proskauer Rose.
El abogado de Google Adam Barea calificó las demandas de daños rechazadas por el tribunal de “infundadas desde el principio”.

This is getting a bit more subjective, but I much prefer the Zune Marketplace. The interface is colorful, has more flair, and some cool features like ‘Mixview’ that let you quickly see related albums, songs, or other users related to what you’re listening to. Clicking on one of those will center on that item, and another set of “neighbors” will come into view, allowing you to navigate around exploring by similar artists, songs, or users. Speaking of users, the Zune “Social” is also great fun, letting you find others with shared tastes and becoming friends with them. You then can listen to a playlist created based on an amalgamation of what all your friends are listening to, which is also enjoyable. Those concerned with privacy will be relieved to know you can prevent the public from seeing your personal listening habits if you so choose.
